These terms explain the framework for using our website and working with American Best Publishers across writing, editing, publishing, marketing, design, audio, websites, branding, and related book and author services.
Project-specific proposals, invoices, statements of work, or signed agreements may contain additional terms. Where a signed project agreement differs from these website terms, the project agreement will control for that project.
Agreement to terms
By visiting this website, requesting information, approving a proposal or invoice, making a payment, or using services provided by American Best Publishers, you agree to these Terms & Conditions. If you do not agree with these terms, please do not use the website or purchase our services.
You confirm that you are legally able to enter into an agreement in your location and that you have the authority to submit any manuscript, artwork, files, brand assets, or other project materials you provide to us.
Definitions
For these terms, Website means the American Best Publishers website and its online content. Client, Customer, You, and Your mean the person or organization requesting or purchasing services. Company, We, Us, and Our mean American Best Publishers. Services include writing, editing, publishing, design, illustration, audiobook production, author websites, branding, marketing, book signing support, consultation, and other book-related deliverables we agree to provide.
Orders & services
An order may be created through a website inquiry, phone or email conversation, approved proposal, invoice, written agreement, payment, or another documented confirmation of scope. The exact service, deliverables, schedule, revision allowance, and payment terms for a project should be confirmed in the applicable proposal, invoice, or service agreement.
Our services may include book publishing, book marketing, ghostwriting, children’s book development, audiobook production, B&N book signing setup, book editing, author websites, book cover and illustration services, author branding, or related professional support.
Payments & refunds
Payments are due according to the invoice, proposal, package, payment plan, or written agreement accepted for the project. Work may begin after the required payment or deposit has been received. If an agreed payment is delayed, the project may be paused until the account is brought current.
Because our work involves professional time, planning, production, and creative labor, amounts already applied to completed or in-progress work may be non-refundable. Any refund eligibility, cancellation right, milestone refund, or special guarantee will be governed by the written terms attached to the specific project. Where no separate refund term exists, refund requests may be reviewed based on the work completed and commitments already made.
Ownership & client use
Unless a separate agreement states otherwise, final client-approved deliverables created specifically for a fully paid project are intended for the client’s use and ownership. Draft concepts, internal working files, licensed third-party materials, software, fonts, platform assets, and other items that cannot legally be transferred may remain subject to separate rights or licenses.
The client remains responsible for how final materials are published, distributed, promoted, submitted to platforms, or used after delivery. You also confirm that materials you provide to us may lawfully be used for the requested project.
Originality & prohibited use
American Best Publishers does not knowingly support plagiarism, copyright infringement, academic dishonesty, impersonation, unlawful content, or unauthorized use of another person’s intellectual property. Original writing and creative development prepared for a client are intended to be unique to that project.
Clients are responsible for using delivered material ethically and lawfully and for obtaining permissions for any third-party text, images, trademarks, recordings, or other materials they ask us to incorporate.
Revisions
Revision terms vary by service and package. The applicable proposal, invoice, or project agreement should define the number or type of revisions included, the stages at which approval is required, and what constitutes a change in scope.
Once a section, concept, draft, design direction, or project stage has been approved, major changes, new creative direction, added content, or work outside the agreed scope may require additional time, fees, or a revised agreement.
Publishing & marketing results
We may provide publishing preparation, platform support, distribution assistance, book marketing, author branding, event coordination, bookstore or retailer guidance, and strategic consultation. Third-party decisions and market response remain outside our direct control.
Unless a specific written agreement expressly states otherwise, we do not guarantee retailer acceptance, bookstore placement, media coverage, rankings, bestseller status, reviews, sales volume, audience growth, advertising results, or any other specific commercial outcome.
Third-party platforms & services
Projects may involve third-party payment processors, publishing platforms, retailers, distributors, advertising networks, social platforms, event venues, hosting companies, domain registrars, media outlets, or software providers. These providers operate under their own terms, policies, schedules, technical requirements, and approval processes.
American Best Publishers is not responsible for third-party outages, policy changes, account decisions, platform delays, rejections, fees, errors, or content beyond our reasonable control.
Disclaimer
We make reasonable efforts to provide professional services and accurate website information. However, the website and services are provided subject to the terms agreed for each project and without a promise that every service, platform, timeline, or outcome will be uninterrupted, error-free, or suitable for every individual purpose.
Clients are responsible for reviewing final deliverables, factual claims, legal or regulated statements, platform requirements, and publication decisions before use.
Limitation of liability
To the fullest extent permitted by applicable law, American Best Publishers and its employees, contractors, representatives, affiliates, and service providers will not be responsible for indirect, incidental, special, consequential, punitive, or similar damages arising from website use, project delays, third-party decisions, technical issues, market response, or the client’s use of delivered materials.
You agree to be responsible for claims arising from materials you provide, your breach of these terms, your violation of third-party rights, or unlawful use of delivered work.
Changes to these terms
We may update these Terms & Conditions as our website, services, platforms, operational practices, or legal requirements change. The current version will be posted on this page with an updated effective date. Continued use of the website or services after an update may constitute acceptance of the revised terms where permitted by law.
